The 5176 numbered Law on the Establishing the Ethical Board of Public Servants and Amending of Some Laws came into force with its publication in 25486 numbered Official Gazette on June 8th 2004;
The 2004/7791 numbered Decision of the Council of Ministers on the Appointment of the Chairman and Members of the Ethics Committee came into force with its publication in 25578 numbered September 9th 2004 dated Official Gazette; and
The Principles of Ethical Conduct of Public Officials together with the Regulation on Application and Principles came into force with its publication in the 25785 numbered April 13th 2005 dated Official Gazette respectively.
Purpose of the Directive;
To determine the principles of ethical behaviour that they must comply with, to help them to behave in accordance with these principles, to increase public confidence by eliminating situations that harm the principles of justice, honesty, transparency and impartiality and create mistrust in society and to inform the public about the behaviours that they are entitled to expect from public officials and to regulate the procedures and principles of application to the board.
Kusadası Municipality Public Servants Ethics Code of Conduct and Application Procedures and Principles Directive;
In accordance with the provisions of the 5176 numbered Law on Establishing the Ethical Committee of Public Servants and Making Changes to Some Laws and The Principles of Ethical Conduct of Public Officials together with the Regulation on Application and Principles which came into force with its publication in the 25785 numbered April 13th 2005 dated Official Gazette;
A “Kuşadası Municipality Public Servants Ethics Code of Conduct and Application Procedures and Principles Directive” was prepared and accepted by the Mayorship with the E.843 numbered decision taken on 26.06.2019 in relation to the regulation of procedures and principles relating to the application, review and other procedures to be implemented for those Public Servants working in Kuşadası Municipality and those public servants who do not enter the field of the Ethics Board for their actions which are in contrary to the principles of ethical conduct.
In accordance with Article 29 of the Law on Establishing the Ethical Committee of Public Servants and Regulations on Ethical Conduct Principles and Application Procedures and Principles which came into force with its publication in the 25785 numbered and 13.04.2005 dated Official Gazette;
The Ethics Commission has been established by our Mayor to establish and improve the Ethical Culture, advise and direct the problems faced by staff regarding ethical conduct principles, and to evaluate ethical practices.
The Ethical Commission’s task is to place and develop the ethical culture in institutions and organizations, advise and guide the issues faced by staff on ethical code of conduct, and to evaluate ethical practices.
In Article 29 of the Application Procedures and Principles Directive with The Principles of Ethical Conduct of Public Servants of Kuşadası Municipality, the duties of the members of the Ethics Commission are limited to (1) years. However, the Mayor can change the Commission Members if needed.
The Ethics Commission works in cooperation with Prime Ministry Ethics Committee of Public Servants.
In accordance of the 441152 numbered and 15.02.2019 dated decision of the Public Servants Ethics Committee it was decided to celebrate May 25-31 as “Ethical Week” every year.
Ethics Commission Activities
After the Public Officials’ Code of Ethical Conduct and Application Procedures and Principles Directive came into force, Appendix-1 Public Officials Ethics Agreement was signed to all personnel and put in their personal files.
Makes sure all new personnel signs this agreement forms from the date of their employment and ensures the signed agreement is placed in employee’s personal file.
In addition to this, all Public Official Candidates are given training on the Principles of Ethical Conduct of Public Servants within the scope of their “In-service Trainings During the Candidacy Period”
Prepared on the basis of Articles 3 and 7 of the 25.05.2004 enforced “Law on the Establishment of a Public Officials Ethics Board and Amendments of Some Laws”; and in line with our services provisions in accordance to “Article 26 of the Corporate Ethical Principles” of the Regulation on Ethical Behaviour Principles and Application Procedures and Principles of Public Officials which came into force with its publication in the Official Gazette on 13.04.2005 works have been commenced in our municipality to obtain the opinions and suggestions of the departments in relation to the determination of the ethical behaviour principles.
In-service trainings will be provided for civil servants, workers and contract educators and first-stage administrative staff by the Human Resources and Training Department on “Work Ethics and Duty Responsibility” in order to ensure that the principles and procedures specified in the Regulation of the Ethical Behaviour is applied in utmost capacity by all Public Officials working under our Mayoralty and in order to create an institution culture related to the principles of Ethical Conduct.
The Commission conducts its regular meetings every three months- on the first Monday of January, April, July and October- in the office of Commission Member Deputy Mayor.
